 「短期的にはタリバーンに圧力をかける。周辺国からも情報をとって、ビンラディンの居場所などをきっちりつかむ。目標に対し効果的な行動をとるのが軍事行動で一番大切。米国も最初は激しい怒りで対応していましたが、いまは情報取りを一生懸命やっている。犠牲を最小限にして、効果のある攻撃ができるか。ビンラディンの引き渡しがあれば最高です」「長期的には、アフガンでも、中東でも、多くの人が安全も安定もなく、日常生活にも困っている。これを直さないと。アフガンでは周辺の国も全部、国内に抵抗分子を抱えています。そこまで視野に入れた安定策を作っていくことが大事。国造りではなく『地域造り』。そのためにはおカネも技術もいる。それが私たちの安全につながるという意識が必要です」

――「平和と人道の象徴」の緒方さんが効果的な軍事行動を説くと日本の人々が驚くでしょう。
「私が難民の保護と救済のため話し合ってきた人は相当のしたたか者ばかり。難民に制限を加えるとか、追放するぞと脅すとか。どっちがより悪くないかの選択を迫られてきたんです。きれいごとじゃありません」「日本の方々はあまりに現実を知らない。平和の国にいたから。政治家の方に『もうちょっと現場を見に行ってほしい』と言ったことがある」
加藤尚武氏からの三つのアピール

 鳥取環境大学学長で 日本哲学会委員長の 加藤尚武氏から、以下のメールを受け取りました。

 私の三つのアピールを送ります。
 もしも趣旨に賛同してくださったら、これらのメッセージをなるべく多くの人に転送してください。いかなる形の転載にも同意します

 同時多発テロに対する報復戦争の国際法的な正当性は成り立たない

 1、国際法上の「戦争」とは、単に軍事行動が行われたという時点では成立せず、主権国家もしくはゲリラ団体が戦争の意思表示をすることで成立します。ゆえに、今回の同時多発テロは犯罪であって、戦争ではありません。犯罪として対処すべきです。(典拠:パリ不戦条約TREATY FOR THE RENUNCIATION OF WAR ASAN INSTRUMENT OF NATIONAL POLICY 1929)
2、国際法では、いかなる紛争にたいしてもまず平和的な解決の努力を義務づけています。ブッシュ大統領が、同時多発テロの今後の連続的な発生の可能性に対して、平和的な解決の努力を示しているとは言えないので、新たな軍事行動を起こすことは正当化されません。(典拠:国連憲章2条3項、33条)
 3、国際法は、報復のために戦争を起こすことを認めていません。したがって、たとえ同時多発テロが戦争の開始を意味したとしても、現在テロリストが攻撃を継続しているのでないかぎり、報復は認められません。(典拠:国連憲章51条)
 4、同時多発テロに対する報復戦争が正当防衛権の行使として認められるためには、現前する明白な違法行為に対しておこなわれなくてはなりません。予防的な正当防衛は、国際法でも国内法でも認められていません。同時多発テロに対する報復戦争を正当防衛権の行使として認めることはできません。(典拠:国連憲章51条)
 5、国家間の犯人引き渡し条約が締結されていないかぎり、犯人引き渡しの義務は発生しないというのが、国際法の事実上の原則です。「犯人を引き渡さなければ武力を行使する」というアメリカ大統領の主張は、それ自体が、国際法違反です。(典拠:国連憲章2条4項)
 以上の理由によって、私は同時多発テロに対する報復戦争は正当化できないと判断します。

In terms of international law, there is no legitimacy for wars of
retaliation against the recent terrorist attacks.

1. A conflict becomes recognized as a "war" from the perspective of
international law not simply when military actions are taken, but when a
sovereign state or a guerrilla group expresses its intention to wage a
war. Therefore, the recent terrorist attacks would be recognized as
crimes, not as a war. Thus, the recent incidents should be treated as
crimes.(source:TREATY FOR THE RENUNCIATION OF WAR AS AN INSTRUMENT OF
NATIONAL POLICY 1929)

2. International law makes it clear that efforts for peaceful resolution
should be made first to deal with any disputes. Since President Bush has
not demonstrated efforts to resolve any possibility of future
occurrences of the terrorist attacks in peaceful way, new military
actions are not legitimate.(source:CHARTER OF THE UNITED NATIONS
Art.2(3),Art.33)


3. International law does not recognize the legitimacy of wars of
retaliation. Therefore, even if the terrorist attack this time signifies
a beginning of a war, retaliation cannot be allowed unless the
terrorists continue their attacks.(source:CHARTER OF THE UNITED NATIONS
Art.51)

4. In order for a war of retaliation against the recent terrorist
attacks to be recognized as legitimately exercising the right of
self-defense, it must be waged against existing and obvious illegal
actions. Preventive self-defense is not accepted by either international
law or domestic law. Therefore, a war of retaliation against the
terrorist attacks is not accepted as a legitimate act of
self-defense.(source:CHARTER OF THE UNITED NATIONS Art.51)

5. The de fact principles of international law imply that there is no
obligation
for one state to hand over criminals to another state unless an
agreement to do so has been concluded between the two states. President
Bush's argument that military force will be used if the criminals are
not handed over is itself in violation of international
law.(source:CHARTER OF THE UNITED NATIONS Art.2(4))

For the reasons stated above, I conclude that a war of retaliation
against the terrorist attacks is not legitimate under international law.

 ゲルニカを忘れないで

  テロリズム攻撃のもっとも憎むべき点は、それが無差別殺人であるということである。そのビルで働く市民、その飛行機に乗り合わせた市民がすべて無差別に殺害されたということである。
  テロリストが拷問をしたときテロリストに拷問をする、テロリストが生物兵器を用いたときテロリストに生物兵器を用いることは、加害者に被害者と同じ苦しみを与えるのであるから、これは報復である。報復であるが正義ではない。「拷問は不正である」、「生物兵器の使用は不正である」という加害者と被害者に共通して適用される原則が守られていないからである。
  テロリストが無差別殺人をしたとき、空爆によって、テロリストを客人として扱うタリバンの支配下にあるアフガニスタン国民を無差別殺人に処することは、報復でもないし正義でもない。「報復」でないのは、アフガニスタン国民は加害者ではないからである。「正義」でないのは、「無差別殺人は不正である」という共通の原則が守られていないからである。
   1、スペインの町ゲルニカGuernicaにフランコ将軍の側にたったドイツ飛行機 による無差別爆撃が行われたとき(1937)、世界中が憤激し、ピカソは大作ゲルニカを発表した。アメリカ大統領フーバーは「非戦闘員の殺傷が不正であること」を再確認する書簡を発表した。
  2、しかし、アメリカが第二次世界大戦に参戦(1941)し、日本対する空爆が有効な手段と見なされる段階になると「非戦闘員の殺傷が不正であること」という原則は事実上無視された。しかし「現存する戦闘行為を停止させる不可欠の手段」として正当化された。原爆の投下、ベトナムでの空爆、湾岸戦争での空爆、 ユースラビヤ内戦での空爆は、いずれも「現存する戦闘行為を停止させる不可欠の手段」として正当化された。
 3、もしもテロリスト攻撃への報復という理由でアフガニスタンで空爆がなされるとしたら、もはや「現存する戦闘行為を停止させる不可欠の手段」という意味を持つことはない。「テロリストの次の攻撃に先手をうつ先制攻撃」として空爆が行われることになる。湾岸戦争での空爆、ユースラビヤ内戦での空爆が、たとえ正当化されたとしても、同じ理由で正当化することのできない、空爆の新しい適用事例となる。
  テロリズムの無差別殺人を憎むものが、空爆という先制攻撃をアフガニスタン国民に行うならば、無差別殺人という同じ罪を犯すことになる。世界はゲルニカの時代に逆流するのだろうか。ピカソの作品が訴えていたものが「非戦闘員の殺傷が不正であること」であったことを世界中が忘れようとしている。

 Do you rembmber Gernica?

The most unpardonable aspect of terrorism is that it is an
indiscriminate murder. The citizens who worked in the WTC towers and who
were on board the hijacked planes were killed.
Suppose we torture terrorists when terrorists tortured our citizens, or
we attack terrorists with biological weapons when terrorists attacked us
by biological weapons. It is a reprisal because it gives the assailants
the same suffering as the victims. It is a reprisal but not justice. For
in both cases one and the same principle, ie. that torture is unjust or
that the use of biological weapons, is unjust is not applied to both the
victims and assailants equally.
Suppose we indiscriminately kill the citizens of Afghanistan who treats
a terrorist as a guest because the terrorists killed our citizens
indiscriminately. Then it is neither a reprisal nor justice. It is not a
reprisal, since the citizens of Afghanistan are not assailants. It is
not justice, since the same principle that indiscriminate killing is
unjust is applied equally.
1. When Germany attacked Gernica, a Spanish city, by indiscriminate air
bombardment in 1937, people all over the world burned with indignation.
Pablo Picasso painted Gernica. President Hoover issued a note to confirm
“the principle that killing of civilians is unjust”.
2. But the principle was virtually ignored when it came to WW II in
which air raids were recognized as effective weapons against Japan. They
were justified as an indispensable means to stop the present actions of
war. Atomic bombs against Hiroshima and Nagasaki, air bombardments
against Vietnam, air raids during the Gulf war and air attacks during
the civil war in Yugoslavia were justified in the same manner.
3. If we attack Afghanistan we cannot justify it “as the indispensable
means to stop the present actions of war”. It is “to launch air
bombardment against terrorists preemptively to abort the next attack by
the terrorists”.  It is a new precedent of the use of air bombardment.
It cannot be justified even if the air bombardments in Gulf war and the
civil war in Yugoslavia can be.
If we who hate the indiscriminate killing by terrorism resort to a
preemptive and indiscriminate air bombardment, we are committing a
injustice of indiscriminate killings. Are we going back to the times of
Gernica? Have people all over the world forgotten the fact Picasso had
painted the piece to appeal to the world that “killings of civilian are

 死者は自分の身体にかかった血と砂と油が、
 アフガンの子どもたちの血でそそがれることを求めてはいない。
 死者はただ世界中の人々の涙と愛でぬぐわれることを求めている

 死者にはもう家族との団らんはない
 日々の仕事のなかでのささやかな楽しみや微笑みや語らいもない
 死者はただ生きている人々が
 日々の営みを明日にもまたその明日にも続けてくれることを求めている
 戦場に出て戦うことを求めてはいない
 何万という人々に家をすてて荒野に流離うことを求めてはいない

 死者のかたわらに死者がいる
 殺された多くの死者のかたわらに殺したわずかな死者がいる
 死者と死者は和解することができないだろう
 そこに新しい死者があらわれる
 アフガンの荒野で食べ物も薬もなく
 手当といえばただ抱きかかえれるだけでなくなった子どもたち

 殺した死者が手をさしのえると子どもたちは恐怖に身をこわばらせる
 殺された死者は手をさしのべようとしない
 殺した死者が抱き上げようとすると子どもたちは嫌悪に身をそらせる
 殺された死者がやっと手をさしのべると
 子どもたちはその手に抱かれる

 子どもたちを抱いて死者たちは浄化への道を歩もうとする
 するとまた子どもたちが現われる
 殺された死者たちが腕にいっぱいの子どもたちを抱きかかえて
 浄化への道を歩もうとするとまた子どもたちがあらわれる

 子どもたちが現われるたびごとに死者たちは道をひきかえす
 いつまでもいつまでも死者たちは浄化への道を歩みはじめることができない

 時間のフイルムをもとにもどそう
 まだ一人の子どもも殺されてはいなかった時にもどそう
 そして
 死者が安らかに浄化への道を歩むことを祈ろう
